Commissions Terms and Conditions
Acceptance
It is not necessary for the Client to have signed any document for these terms and conditions to apply. If the Client commissions a portrait from Emmanuelle Orr, either via email agreement or through the commission order page on www.emmanuelleorr.com, then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.
Please read these terms and conditions carefully. Any commission or use services implies that you have read, understood and accepted these terms and conditions.
Price Quotations
Charges for services to be provided by Emmanuelle Orr are defined in the price quotation that the Client will receive, upon request, via email, or via the commission order page on www.emmanuelleorr.com. Quotations are valid for a period of 30 days. Emmanuelle Orr reserves the right to alter or refuse to honour a quotation after expiry of the 30 days.
Scope of work
Unless otherwise agreed in writing by Emmanuelle Orr and the Client, the scope of the commission will be as follows.
One edition of 1 to 5 screen-prints on paper (as per agreed quantity) based on a photograph provided by the Client.
The portrait will focus on one person only, unless otherwise agreed in writing. No background or secondary figures will be included. Portraits can be in landscape or portrait orientation.
All images will be printed using the CMYK printing process (using Cyan, Magenta, Yellow and Black process inks). No other ink colours will be included. All inks used to be water-based inks.
The image will be halftoned using a round pattern and a density of 5 (yellow layer) or 7 (other layers) lines per inch (LPI). This means that the image will be made up of a pattern of large overlapping dots. Changes to the LPI or the pattern must be agreed in writing by Emmanuelle Orr and the Client.
The print will be B3 (approx. 35 x 50 cm) or A3 (approx. 29.7 x 42 cm) format, as agreed between Emmanuelle Orr and the client.
The print will be on 300 gsm (or higher) white paper (G.F. Smith Naturalis range or similar).
Please note the following disclaimers:
The Photoshop mock-uk of the design is not contractual and shared as an indication only. Colours may look slightly different on paper, and registration may vary slightly.
Due to the printing process, minor ink marks may be present on the final prints around the image.
As the screenprints are handmade, small variations may exist between the prints in the multi-prints editions.
Additional Expenses
The Client agrees to reimburse Emmanuelle Orr for any additional expenses incurred for the completion of the work. Examples of these instances would be postage charges, extra travel expenses for delivery etc.
Emmanuelle Orr agrees to provide standard materials necessary for producing the screenprint such as as: standard white paper, positives, ink, emulsion and other chemicals.
Any additional materials such as (but not limited to) glitter, special inks or other enhancement would need to be agreed with Emmanuelle Orr at the commissioning stage and would carry further charges.
Installation and framing
Unless agreed in the commission quote installation or framing of the artwork will be completed by The Client.
Photo Provision
The Client will be required to provide suitable photographs for the commission work to be produced, with a high enough quality for printing at the required size. The Client must have permission to use such photographs & it is their responsibility to not breach any copyright laws.
Artwork progress
Once work commences on a Client’s portrait, Emmanuelle Orr will email images of the progress of the Artwork Design & an estimated completion date.
The commission process will include the following stages: design, positive printing, printmaking.
During the design stage, Emmanuelle Orr will prepare a design for the print using the photograph sent by the Client, including isolating the subject, and making minor alterations (enhancing the colour profile etc..), and preparing the layers for printing (CMYK halftone preparation and creation of a Photoshop mock-up of the print).
At this stage minor alterations can be made to its design content, until the design stage is completed.
Emmanuelle Orr will then organise for the positives (B&W prints on acetate of each of the 4 colour layers for screenprinting). No further alterations are possible once this stage has started.
Emmanuelle Orr will then proceed to print the image on paper as per the scope agreed.
Emmanuelle Orr will print additional copies of the prints to allow for wastage and to be able to deliver the agreed number of prints in the edition. Any print wastage or additional print beyond the scope of the edition will be destroyed and will not be used by Emmanuelle Orr for any other purposes.
Emmanuelle Orr reserves full judgement on what constitutes acceptable minor printing variation versus printing wastage.
Emmanuelle Orr reserves the right to share “artwork in progress” photos to social media unless the Client expresses this not to be done. eg a surprise present
Once Artwork is complete Emmanuelle Orr will send photos of the prints to the client, and organise delivery of the prints to the address indicated by the Client during the Purchase process.
Timings
Timelines for each stage of the process to be agreed at the commissioning stage between Emmanuelle Orr and the client but will usually be as follows:
Design stage: 5-10 working days
Screen-printing stage (including positive printing): 5-10 working days.
Please note that other factors may affect the timings such as existing commission pipeline or other pre-existing art commitments, holidays, materials delivery issues, or other studio requirements. All timings for specific projects to be agreed between Emmanuelle Orr and the Client.
Copyright
Emmanuelle Orr declares that the piece of artwork created will be an authentic, original and limited edition piece of art of her own creative efforts and executed by her, from the Client’s photo. The artist retains all copyright.
The Client retains ownership of the artwork but may not reproduce it in any form, without Emmanuelle Orr’s consent. The Client is allowed to share on Social media. If the client wishes to make any reproductions of the Artwork then this must be arranged through Emmanuelle Orr only.
Emmanuelle Orr will not reproduce the Artwork & its usage will not be allowed on any other website apart from Emmanuelle Orr website and social media pages, unless the Client gives written permission to do so.
Emmanuelle Orr reserved the right to display the artwork on their website and social media pages for marketing purposes only. If a Client is unhappy about the artwork being displayed, they must declare this upon placing the commission.
Payments
Full payment is expected from the Client at the commissioning stage to confirm a commission slot and before Emmanuelle Orr commences work.
Invoices are primarily sent via email. The Client will also be required to provide a current postal address to receive hard copy invoices. Payment in full is due within 7 days of invoice. Please note, unless specifically agreed to by both parties prior to the issuing of an invoice, Emmanuelle Orr does not accept payment in part or via instalments.
Emmanuelle Orr accepts payment by the following methods:

Credit/Debit Card via the www.emmanuelleorr.com website or in-person

For termination before completion of commission
If the client chooses to terminate the services of Emmanuelle Orr after agreeing a commission arrangement but before the commissioned project is complete, Emmanuelle Orr reserves the right to charge up to 85% of the total projected costs. The scale of the charge will be dependent on the discretion of Emmanuelle Orr and the stage of the project at the time of cancellation.
Should the Client cancel the commission agreement after the Artwork has been completed (but before shipping), Emmanuelle Orr reserves the right to charge up to 100% of the total projected costs. The scale of the charge will be dependent on the discretion of Emmanuelle Orr and the stage of the project at the time of cancellation.
If Emmanuelle Orr chooses to terminate the contract as they are unable to fulfil the commission she will return all payments or deposits.
If communication breaks down on the part of the Client for a period of 30 days (that is, the Client fails to reply to a communication from Emmanuelle Orr ) Emmanuelle Orr will issue a warning email. If this warning email is not replied to (and communication does not resume) with a following period of 30 days, Emmanuelle Orr reserves the right to to terminate the commission. In this event, Emmanuelle Orr reserves the right to charge up to 90% of the total projected costs and the commission will be cancelled. The scale of the charge will be dependent on the discretion of Emmanuelle Orr and the stage of the project at the time of cancellation. If the Client wishes to continue the commission at a later date they will be required to request a new project quotation, sign a new Commission Agreement and pay a further non-refundable deposit.
Governing Law
If either or the parties is not a UK resident then the UK Governing Law will apply to this agreement.
Returns & Disputes
With Commissions all sales are final and Emmanuelle Orr is under no obligation to accept a return for a commissioned artwork, except in the event that the artwork reaches the customer damaged or is faulty.
Warranties or Repairs
Emmanuelle Orr agrees to a “defect period” of 6 months immediately after shipping, during with Emmanuelle Orr agrees to do any necessary repairs. After this time Emmanuelle Orr is not liable for any repairs.
